Terms of Service

1. Agreement to Terms

By accessing or using Airpult ("the Service"), you agree to be bound by these Terms of Service. The Service is operated by Samuenti GmbH, a company registered in Cham, Switzerland. If you disagree with any part of these terms, you may not use the Service.

2. Service Usage

Airpult provides weather forecasts, air quality data, and related information. Users are strictly prohibited from:

• Downloading, scraping, or systematically storing any weather data
• Redistributing or reselling weather information obtained from the Service
• Accessing the Service through automated means or bots without authorization
• Using the Service as an unauthorized data source for other applications

Weather data is provided "as is" and we make no guarantees about its accuracy or availability.

3. API Usage

Access to the Airpult API requires an API key issued through your account. API usage is subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary throttling or suspension. API keys are personal and may not be shared or redistributed. We reserve the right to revoke API access for any violation of these terms.

4. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials, including your password, passkeys, and API keys. Airpult is not liable for any loss or damage resulting from unauthorized access to your account.

5. Payment Terms

Subscription fees for premium features are billed in advance on a monthly or annual basis. All payments are processed by Mollie. Fees are non-refundable unless required by applicable law. You are responsible for all applicable taxes, and we will charge tax where required.

6. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuance of the Service.

7. Limitation of Liability

Airpult shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. This includes any decisions or actions taken based on weather data, forecasts, or air quality information provided through the Service.

8. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

9. Data Sources

Weather and air quality data is sourced from various third-party providers. While we strive for accuracy, we cannot guarantee the precision of forecasts and related information. The Service should not be relied upon as the sole source of information for safety-critical decisions.

10. Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Canton of Zug, Switzerland.

11. Changes to Terms

We may update these Terms at any time. Significant changes will be communicated via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
